1. Acceptance of terms

By creating an account, accessing, or using Château Cheval Stables, you agree to be bound by these Terms. If you do not agree, you may not use the service. If you use the service on behalf of a business or organisation, you represent that you have authority to bind that entity.

2. Description of the service

Château Cheval Stables is a cloud-based software platform that helps horse boarding and training facilities manage horses, owners, staff, feeding, supplements, vet and farrier records, turnout schedules, billing, and daily operations.

3. Account registration and security

You must provide accurate information when creating your account and keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must notify us promptly of any unauthorised use.

4. Acceptable use and prohibited conduct

You agree to use the service only for lawful purposes. You must not, and must not attempt to:

• use the service for any unlawful, fraudulent, or harmful activity;
• send spam, phishing, or other unwanted communications;
• infringe intellectual property rights or other proprietary rights of any person;
• introduce malware, viruses, or other harmful code;
• interfere with the security, availability, or performance of the service, including probing, scraping, or reverse engineering;
• circumvent usage limits, access controls, or technical restrictions.

5. User content

You retain ownership of any content you upload, including horse records, photos, documents, and notes. You grant us a limited, non-exclusive, royalty-free licence to host, process, and display that content solely to provide the service to you.

You represent that you have the right to upload any content you provide and that it does not violate the rights of any third party or any applicable law.

6. Intellectual property ownership

trista cummings owns and retains all rights, title, and interest in the Château Cheval Stables software, branding, documentation, and associated intellectual property. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the service during your subscription term.

7. Subscriptions, payments, and cancellations

Subscriptions are billed through our online reseller, Paddle.com. By subscribing, you agree to pay all applicable fees and taxes. Billing frequency and amounts are shown at checkout and in your subscription details.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

You may cancel your subscription at any time through your billing settings or by contacting Paddle. Access continues until the end of the current paid period.

8. Refunds

Refunds are governed by our Refund Policy. Please read it before subscribing.

9. Suspension and termination

We may suspend or terminate your account, with or without notice, if you materially breach these Terms, fail to pay fees, pose a security or fraud risk, or repeatedly or seriously violate our policies. Upon termination, your right to use the service ends immediately, and we may delete or anonymise your data in accordance with our Privacy Notice.

10. Disclaimers and service level

The service is provided “as is” and “as available” without warranty of any kind. We do not guarantee that the service will be uninterrupted, error-free, or completely secure. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

11. Limitation of liability

To the extent permitted by law, trista cummings’ aggregate liability for any claim relating to the service is limited to the amount you paid for the service in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, consequential, incidental, special, or punitive damages, including lost profits, data loss, or goodwill, except where liability cannot be excluded by law (for example, fraud, death, or personal injury).

12. Indemnity

You agree to indemnify and hold harmless trista cummings from any claims, damages, losses, or expenses arising from your content, your use of the service, or your violation of these Terms.

13. Governing law and disputes

These Terms are governed by the laws of the jurisdiction where trista cummings is located, without regard to conflict of laws principles. Any dispute arising from these Terms or the service will be resolved exclusively in the courts of that jurisdiction, unless otherwise required by law.

14. Changes to these terms

We may modify these Terms from time to time. If we make material changes, we will notify you at least 30 days in advance by email or by posting a notice in the service. Continued use after the changes take effect constitutes acceptance.
